FAQ

How can I get updates on the status of my case?

Throughout the mandate, your lawyer will keep you updated on the status of your case. You will receive all letters, emails and procedural documents transmitted by the opposing party. We will also ask you to approve all letters and procedural documents sent to them. In addition, you will be consulted during each step of the process.

How does Dessureault Herbert charge for its services?

Our fees are charged by the hour, based on the work performed; they will be discussed prior to the initial consultation. You will not be charged a file opening fee, nor will you be charged for photocopies unless they pertain to the preparation of trial notebooks required by the Court. All legal costs, including bailiff fees and court filing fees required for the issuance of procedural documents, will be billed to you on an actual cost basis. We may have to charge for travel expenses if we are required to go to a courthouse located outside the Greater Montréal region.

Can your lawyers represent me anywhere in Québec?

Yes, of course, subject to reaching an agreement of travel expenses, as applicable. To minimize costs, if permitted by the Court, we may be able to plead cases virtually in certain cases.

If I want to settle my case out of court, what do you suggest?

We regularly assist our clients with the out-of-court settlement process. We frequently advise individuals involved in a mediation process with their ex-common-law spouse (or ex-spouse). We can represent you during a settlement conference held under the guidance of a Superior Court judge or a retired judge. This process also has a very high likelihood of success and often represents a less costly and more advantageous solution than going to trial. We will take steps to draw up an agreement covering all aspects of your dispute and containing all the necessary clauses to ensure a final resolution.
