I’m getting separated and my children attend a private school. How should my ex and me divide up the payment of the school fees?

Following the separation, the shared payment of expenses relating to your children will be divided into expenses considered “basic” and those considered “particular”.

Basic expenses such as housing, food, clothing, transportation and certain recreation expenses, etc. are considered when calculating child support payments and are not subject to any specific accounting requirements.

Shared basic expenses such as public school fees are paid equally by parents in shared custody situations; otherwise, they are paid exclusively by the parent who has exclusive custody.

Private school fees are particular expenses. Therefore, they are shared proportionately, based on each parent’s income. Here are some other examples of particular expenses: orthodontist fees, expenses for medical or paramedical treatments, computers required for particular programs or expenses relating to elite sports (AAA hockey, ski competitions, etc.).

Particular expenses are defined as expenses dictated by a child’s particular situation.
