If I don't sign a marriage contract, what happens to my assets in case of divorce?

Couples who don't sign a marriage contract and get married in Quebec (subject to certain exceptions) are subject to the legal regime of the partnership of acquests. The value of their assets accumulated during the marriage will normally have to be shared equally in the event of divorce, always subject to certain exceptions.

Even if you sign a marriage contract establishing that you are married under the regime of separate property, the value of certain assets accumulated during the marriage, such as your family residence, will be subject to division due to family patrimony.

Whether it’s for the partnership of acquests or family patrimony, certain exceptions apply during division, especially for inheritances or gifts received. Consult us to know your rights!
